In a decisive move to combat alleged extortion and abuse of authority within state and municipal police forces, Baja California Sur Congresswoman Guadalupe Saldaña (PAN) has introduced a bold initiative to toughen penalties for such offenses. The proposed reforms include raising punishments significantly and imposing a disqualification period of up to 10 years for officers found guilty of these crimes.

During a legislative session this Tuesday, Saldaña underscored the urgency of the matter, highlighting numerous accounts of abuse, particularly targeting tourists. Victims have reported being stopped arbitrarily and coerced into paying illegitimate fines or "transit fees."

“This measure represents a significant step towards eradicating practices that tarnish the reputation of Baja California Sur as a safe and competitive destination,” Saldaña asserted. She emphasized that beyond violating the rights of visitors, such misconduct undermines public trust in law enforcement and harms the region's image as a reliable and desirable destination.

Key Highlights of the Proposal

The initiative seeks to amend Article 246 of the Penal Code to include harsher penalties for extortion when committed by police officers outside their jurisdiction. Key elements include:  

  • Increased Penalties: Sentences extended by up to two-thirds for offenders.  
  • Mandatory Dismissal: Immediate removal from the officer's position.  
  • Disqualification Period: A 10-year ban on serving in any public security capacity.  


These measures aim to deter unethical behavior and restore confidence in the state’s law enforcement institutions.

A Step Towards Justice
Saldaña’s proposal has been forwarded to the Permanent Commission of Constitutional Points and Justice for detailed analysis and a subsequent ruling. If approved, this legislation could mark a watershed moment in the fight against corruption in Baja California Sur.
